D. TERMS AND CONDITIONS OF SALE

This section sets forth the terms and conditions applicable to online purchases of Products from IL BOLERO using the www.ilbolero.com website. IL BOLERO reserves the right to modify these terms and conditions without prior written notice at any time, in its sole discretion.

D-1 Order

Before submitting an order for the purchase of Products using this website, you will be shown an order confirmation screen (the “Order Confirmation”) describing, among other things, the Product(s) that have been selected, the purchase price and any applicable charges for shipping and taxes. Unless provided for otherwise in virtue of the Quebec Consumer Protection Act, when you submit your order (by pressing the [“Confirm”] button), such order will constitute an offer from you to IL BOLERO to purchase the Product(s) described in the Order Confirmation, for the price and subject to the other charges, terms and conditions set out in the Order Confirmation. Orders are not binding on IL BOLERO until accepted by IL BOLERO. IL BOLERO’s acceptance of your order is evidenced by a return e-mail from IL BOLERO indicating that your order has been accepted.

D-2 Cancellation and Product Availability

IL BOLERO reserves the right, in its sole discretion, to terminate accounts, to limit quantities, and to refuse or cancel any order, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. In the event that your order is cancelled after your payment has been processed, IL BOLERO will issue a full refund. In the event that the price or related information for a Product is incorrect due to an error in pricing or product information, IL BOLERO will contact you to ask you to place a new order for the Product. The availability of certain Products may be limited, and Products may not be available for immediate delivery. IL BOLERO may revise or cease to make available any Products at any time without prior notice. In the event that IL BOLERO is unable to deliver you a Product ordered due to lack of availability, IL BOLERO will notify you via email and your order will be automatically cancelled with respect to such unavailable Product, provided that IL BOLERO may, in its sole discretion, contact you in order to allow you to maintain your order subject to a revised delivery time if and when the Product becomes available.

D-3 Price

All prices quoted are payable in Canadian Dollars. Although IL BOLERO strives to provide accurate Product and pricing information, errors may occur. IL BOLERO reserves the right to correct any errors in pricing or product information and to modify the prices of Products, at any time, without prior notice. IL BOLERO cannot confirm the price of a Product until after you submit an order for the Product. IL BOLERO cannot force you to buy a Product at a higher price.

D-4 Payment Terms

Terms of payment shall be determined by IL BOLERO, in its sole discretion. Payment shall be made by credit card unless some other pre-arranged method of payment has been accepted by IL BOLERO. Any payments made by credit card are subject to the approval of the financial institution that has issued the credit card.

D-5 Shipping & Taxes

IL BOLERO will ship the Product(s) you ordered according to the delivery method you have chosen and to the address (IL BOLERO will only ship Products to addresses located in Canada) indicated in the Order Confirmation. Delivery times provided by IL BOLERO are estimates only. IL BOLERO shall not be responsible for any damages or costs resulting from any delays in delivery.

Unless otherwise stated, all prices quoted do not include shipping and handling charges and applicable federal and provincial sales taxes. Separate charges for shipping and handling and taxes will be shown on the Order Confirmation for each order, as applicable. You must pay for all sales, use, goods and services, harmonized sales, and other taxes and duties associated with the order before the Products are shipped to you.

D-6 Ownership & Risk of Loss

All Product(s) purchased from IL BOLERO are delivered to you by a third party delivery company, pursuant to a shipping contract. You shall become the owner of the Product(s) and shall assume the risks of loss at the time of delivery by IL BOLERO of the Product(s) to the third party delivery company.

D-7 Returns

Due to the intimate nature of the products sold on this website, All sales are final. We do not refund or exchange any item. You cannot return an item if the size does not fit you or you don't like the colour. The only reason you can return an item is if it is defective or does not match its description on the website. Note that the manufacturer's warranty still applies.  

In the case of a return for a warranty issue, please note that you must have an autorization number prior from IL BOLERO. In most cases, you (the customer) have to cover for the shipping fees to send the item back and forth to us. We (the retailer) usually cover the shipping fees to send the item back and forth to the manufacturer.
